Introduction

The following terms and conditions apply to all transactions on www.PoppyKB.com (hereinafter called the ‘Website’), telephone sales and the use of the Website itself. Please read these terms and conditions carefully as they contain important information about your rights and obligations.

In these terms and condition (hereinafter called the ‘Conditions’) the terms ‘we’, ‘us’, ‘our’ refer to ADKB Limited (trading as Poppy KB™) and ‘you’ and ‘your’ refer to any visitor to the Website or ADKB Limited (trading as Poppy KB™) customer.

This document (together with any documents referred to in it) tells you the Conditions upon which we sell and supply the goods (hereinafter called the 'Goods') listed on this Website to you. By using this Website and shopping with us, you, as the visitor to the Website or customer of ours, agree to be bound to the terms and conditions stated below.

‘Goods’ are those items that are advertised for sale on the Website.

2. Eligibility to purchase from the Website

To be eligible to purchase Goods on this Website, you must be:

  • 18 years of age, or older. If under the age of 18, a parent or guardian must supervise you placing your order
  • be legally capable of entering into a binding contract
  • provide full details of a delivery address in the United Kingdom or European Union

    3. Prices

    Details of our Goods’ prices are shown on the Website. Prices are quoted in GBP sterling (£) and Euros (€).

    You have the option to shop in GBP sterling (£) or Euros (€). Please note that you will be responsible for any exchange rate charges made by your card provider.

    Details of our delivery charges to the United Kingdom and European Union can be located on our Website at www.PoppyKB.com/delivery. On the Website, prices for delivery are quoted for delivery in the United Kingdom and European Union only. We can delivery to the Rest of the World. Delivery prices for shipping outside of the UK and EU are available by contacting us. We will aim to provide you with a delivery cost to your shipping country within 24 hours.

    The price of Goods quoted on the Website exclude delivery costs.

    Please note that overseas orders may be subject to local import duties and taxes for which you and not us will be liable.

    4. Placing an Order on our Website, Payment & Contract formation

    Any order placed by you on the Website constitutes an offer to purchase the Goods from us.

    A contract between you and us incorporating these Conditions will only subsist after you have made a payment for the Goods and we have confirmed that we have dispatched the Goods. We will send you an 'Order Dispatch Confirmation Notice' e-mail to the address you provided when you placed your order on the Website. The 'Order Dispatch Confirmation Notice' will amount to our acceptance of your offer to buy the Goods from us.

    In the unlikely event that any Goods ordered are not available, you will be notified by email and you will have the option either to wait until the item is available or to cancel your order.

    Payment can be made through PayPal with your credit/debit card or through your PayPal account. Once you have paid for the Goods, you will receive an e-mail notification from PayPal confirming that a payment has been sent to us. The details of the Goods purchased will also be detailed in this communication from PayPal.

    Please note that all orders received from you are subject to acceptance by us. We reserve the right to refuse any order placed by you.

    You will be subject to the version of our policies and Conditions in force at the time that you order the Goods from us.

    5. Delivery

    We aim to dispatch Goods within 24 hours (Monday-Friday). In the unlikely event that there is a problem with your order, we will contact you by e-mail using the e-mail address provided when you ordered the Goods.

    Please refer to our ‘Delivery’ page at PoppyKB.com/delivery for further details about our delivery options and prices. Any dates quoted for delivering the Goods are approximate only.

    The Goods will be delivered to you at the address you provided during the order process.

    We will dispatch Goods by Royal Mail or by courier service. We would ask you to please examine Goods on arrival. Should there be a problem with your delivery, please notify us within 48 hours of receipt of the Goods.

    For Christmas deliveries, we recommend that you check our Website for the last date of delivery. We will endeavour to dispatch all Goods that are in stock within 24 hours. However, we cannot guarantee delivery by 24th December.

    In the event of any Goods being lost or damaged in transit please contact us immediately, either by telephone, +44 (0) 207 277 4179 or by sending us an e-mail to relax@PoppyKB.com.

    6. Overseas Orders

    Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities. Please also note that you must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable for any breach by you of any such laws.

    7. Returns

    We want you to be happy with your products. If you would like to return Goods for any reason, you may do so within 14 days of receiving delivery of your Goods. If you would like to return Goods, you must notify us in writing by either sending us an email to relax@PoppyKB.com or writing to Poppy KB (ADKB Ltd), PO Box 71314, London SE17 9DN, United Kingdom.

    Please quote your name, address, the name or a description of the Goods and your order reference number when contacting us. Upon receipt or your e-mail or letter, we will write to you confirming that you are entitled to a refund.

    We recommend that you obtain proof of posting from the Post Office or use a trackable delivery service as we can only process refunds once we have received the Goods. We cannot be held responsible for Goods that do not reach us. Please kindly note that you must arrange and pay for the costs of returning Goods to us.

    Refunds will be made by crediting the payment card or electronic payment account you used to purchase the Goods (unless otherwise agreed). Refunds will be paid as soon as possible, and in any event within 14 days after the day on which we receive the Goods back.

    8. Cancellation Rights

    You may cancel your order for Goods and receive a full refund at any time prior to receiving an Order Dispatch Confirmation Notice from us by contacting us in writing.

    If we have sent you an Order Dispatch Confirmation Notice, you may cancel your Contract at any time prior to receiving the Goods so long as you provide us with written notice, or if you have received the Goods, so long as you provide us with written notice at anytime within 14 working days starting from the day after you received the Goods.

    Please send your cancellation notice by email to relax@PoppyKB.com or a letter to Poppy KB (ADKB Ltd), PO Box 71314, London SE17 9DN, United Kingdom. Please quote your name, address, the name or a description of the Goods and your order reference number.

    Upon receiving your cancellation notice, we will contact you and provide details of where you must return the Goods and other relevant instructions. You must arrange for and pay for the costs of returning the Goods to us. We recommend that you obtain proof of posting from the Post Office or use a trackable delivery service as we can only process refunds once we have received the Goods. We cannot be held responsible for Goods that do not reach us. We reserve the right, at our option, to collect the Goods from you.

    The Goods must be returned to us in the same condition in which you received them until such time as the Goods are either collected by us or delivered back to us by you. You must take reasonable care of the Goods whilst they are in your possession and return the Goods in their original packaging.

    Once we have received the Goods, a refund will be paid to you as soon as possible, and in any event within 14 days of our receiving the Goods back.

    9. Damaged, faulty or wrongly delivered goods

    In the unlikely event of you receiving from us damaged, faulty or wrongly delivered Goods, we will offer you a refund of the full purchase price, including the cost of delivery for sending the goods to you and the cost of returning the Goods to us, provided that you return the Goods to us. Alternatively, at your option, instead of a refund we will replace the Goods with the same or a similar product (subject to stock availability and you returning the damaged, faulty or wrongly delivered Goods to us).

    The damaged, faulty or wrongly delivered Goods in terms of which you are claiming a refund must have been damaged on delivery, been delivered in a faulty condition, developed a fault within one month of delivery or have been delivered to you in error. We must also be reasonably satisfied that the Goods have not suffered damage after delivery, the Goods have not been misused or used other than in accordance with the instructions and the problem is not due to normal wear and tear.

    In order to claim a refund or replacement item please send us a cancellation notice as soon as you become aware of a problem and no later than 14 working days after receipt of the Goods, or the fault developing with the Goods, by email to relax@PoppyKB.com or a letter to Poppy KB (ADKB Ltd), PO Box 71314, London SE17 9DN, United Kingdom. Please quote your name, address, the name or a description of the Goods, a brief description of the problem, fault or damage and your order reference number when contacting us.

    Upon receiving your cancellation notice, we will contact you and provide details of where you must return the Goods and other relevant instructions. We reserve the right, at our option, to collect the Goods from you.

    10. Incorrectly priced or described Goods

    Whilst we try and ensure that all the information on our Website is accurate, errors may occur. In the unlikely event that the price and/or description of an item listed on the Website has been incorrectly advertised, we will not be under any obligation to sell or provide those Goods to you. If we discover the error before sending you an Order Dispatch Confirmation Notice we will at our discretion inform you as soon as possible and give you the option of cancelling your order or reconfirming it at the correct price and/or description. If we give you the option of cancelling your order or reconfirming it at the correct price and/or description but either cannot contact you or do not receive your response within 14 days of sending you notification (whether or not you receive it), we will reject your order.

    If your order is cancelled or rejected and you have paid for the Goods, you will receive a full refund.

    11. Risk and title

    The Goods will be at your risk from the time of delivery. Ownership of the Goods will only pass to you when we receive full payment of all sums due in respect of them including the cost of delivery. Legal ownership of the Goods will immediately revert to us if we refund you for the cost of the Goods.

    12. Website Access & Availability

    You will be able to access the Website without having to register any details with us.

    We make all reasonable efforts to ensure that this Website is available to view and use 24 hours a day throughout the year however this is not guaranteed. The Website may be temporarily unavailable at any time because of server or systems failure or other technical issues. Where possible we will try to give you advance warning of maintenance issues but shall not be obliged to do so.

    13. Modifications to Website & Conditions

    We reserve the right to revise and amend the Website, our disclaimers and the Conditions at any time without notice to you. Your continued use of the Website following a change shall be deemed acceptance of such change.

You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable in any way, whether directly or indirectly, for:
